Active License issued by the Pennsylvania State Board of Medicine. Certification from the American Board of Medical Specialties – Oncology.

Role Description:

The Commonwealth of Pennsylvania, Department of General Services, Bureau of Finance and Risk Management is seeking a Board-Certified Oncologist to evaluate the medical aspects of an application submitted for the payment of Line of Duty Death Benefits under 53 P.S. § 891. To qualify for Line of Duty Death Benefits, an eligible beneficiary must show that the decedent was employed by an emergency response or law enforcement entity and died as a result of the performance of their duties. The phrase “died as a result of the performance of their duties” has been interpreted as creating a “but for” causation standard. In other words, the law requires a claimant to prove that but for the performance of the decedent’s duties as an emergency responder or law enforcement officer, the decedent would not have died.

The application and medical records to be reviewed concern a deceased volunteer firefighter. The cause of death identified on the deceased firefighter’s Certification of Death is: Metastatic Colon Cancer. In support of her application, the Claimant submitted an expert report opining that the decedent’s “exposure to IARC Group 1 and other carcinogens [found in the firefighter work environment] were substantial contributing factors to the risk of developing this cancer.”

The Department is seeking to have a Board-Certified Oncologist review the application, medical records, and expert report submitted by the Claimant, and provide an opinion as to whether the decedent’s performance of his duties as a volunteer firefighter was the but for cause of his death. Upon conclusion of the review, the evaluator will be asked to debrief counsel for the Department of General Services on their findings and conclusions. Following the debriefing, the evaluator will be asked to prepare a written report and may be asked to provide testimony at an administrative hearing. It is expected that the evaluator’s written report will include analysis and discussion of the medical literature cited in Claimant’s expert’s report, and analysis and discussion of medical literature supporting the evaluator’s opinion.
